Overloaded boat sinks off Malaysia, 34 Indonesians missing, three dead. 60 survivors arrested under immigration laws

An overloaded boat carrying suspected illegal Indonesian immigrants sank as it left Malaysia's west coast early on Wednesday, and at least three passengers drowned and 34 were missing.
The boat, whose passengers included women and children, sank at the mouth of a river shortly after midnight as it left Malaysia's Carey Island, likely bound for Indonesia's Sumatra island, officials and witnesses said.

Police said the boat lacked safety equipment such as life jackets, but that rescuers were still holding out hope of finding more survivors. The boat went down in shallow water close to shore.

"It is likely that survivors could have swum ashore and went into hiding since they have no legal documents here," said Mohammed Hambali Yaakup, head of operations in the area for the Malaysian Maritime Enforcement Agency (MMEA).

Hambali said he could not confirm reports that a people-smuggling gang had been involved with the boat. All 60 survivors have been arrested under immigration laws, he said.

Malaysia, one of Southeast Asia's wealthier economies, has long been a magnet for illegal immigrants from Indonesia and other poorer countries in the region. Many undocumented Indonesians work in Malaysia's extensive oil palm plantations, a mainstay of its economy.

"This was an illegal boat and all the passengers were Indonesian," Mohamad Zuri, another MMEA official told Reuters.

Police said two bodies had been recovered. A Reuters reporter saw three bodies - two on the deck of a rescue boat and another washed up on shore.

Rescuers were scouring the area for survivors and had deployed a helicopter, one large ship and eight smaller boats in the operation, officials said.

Despite periodic crackdowns on illegal workers, Malaysia is home to an estimated 2 million undocumented immigrants or about 7 percent of its 29 million population.
The question of migrant workers has long been a touchy issue in Indonesia. Both candidates in a July 9 Indonesian presidential race have said that Indonesian workers overseas, often doing menial labour, need better protection.

Immigration: Amnesty condemns Athens for refugee expulsions

Athens - Amnesty International has published a report regarding "the ongoing, persistent and shameful treatment by the Greek authorities of people risking their lives to find refuge in Europe" and has called for the European Union to impose sanctions for direct violations of international human rights obligations. 

According to the report, as To Vima online writes, Greece's treatment of refugees and immigrants on the borders is "deplorable", with the report detailing that violence, intimidation and humiliation tactics have become widespread and routine practices.

The report includes chilling testimonies from refugees and immigrants who attempted to cross over to Greece from neighboring countries, including survivors from the sinking at Farmakonisi. According to the testimonies, refugees are typically stripped of valuables and passports, before being pushed back across the border.

Spain: Accountability urged for ‘appalling’ migrant deaths in Ceuta

Following confirmation by Spain’s Interior Minister that police fired rubber bullets in an attempt to stop migrants from entering the Spanish enclave of Ceuta, which may have contributed to at least 11 drowning deaths, Amnesty International is calling for a full, effective and independent investigation.
The drowned migrants were among some 
250 sub-Saharan Africans who had been attempting to reach Spanish soil on 6 February by crossing into Ceuta via the sea from neighbouring Morocco. 

“This loss of life is appalling, and the Spanish authorities must come clean on what happened – particularly as the Minister’s version of events contradicts earlier official statements. They must determine what went wrong and bring those responsible to account as a matter of urgency,” said Jezerca Tigani, Deputy Europe and Central Asia Programme Director at Amnesty International.

On Thursday evening, in a statement to Spanish Congress, Interior Minister Jorge Fernández Díaz confirmed that members of the Spanish Civil Guard used anti-riot equipment, including rubber bullets, to stop the migrants swimming towards Ceuta on 6 February. At least 11 migrants drowned and a group of 23 people who reached the shore were forced back across the border to Morocco without formal procedures.

In his speech, the Minister said that the riot gear had been used in a way that would ensure that people in the sea were not hit.

“Regardless of whether any of the migrants were hit, it will be up to an independent investigation to determine whether the Civil Guard and border authorities acted appropriately. The results of any such investigation must be made public, and anyone responsible for human rights violations brought to justice,” said Jezerca Tigani.

The Spanish Minister of Interior has admitted that 23 individuals were handed over to Moroccan authorities by the Spanish Civil Guard, after being apprehended on Ceuta’s shores. He claimed that this was lawful, arguing that the migrants had not arrived in Spanish territory.

“Regardless of their location, the 23 individuals were clearly under Spanish jurisdiction once apprehended by the Spanish Civil Guard officers. The actions of the Spanish officials can be described as a push-back operation, the practice of summarily turning back a group of migrants across the border. Summary deportations of migrants or push-backs without giving them a chance to challenge their deportation is a direct breach of Spanish, EU and international obligations; so is the rejection of asylum-seekers at the border,” said Jezerca Tigani.

Amnesty International and local NGOs have documented a number of previous incidents where Spanish authorities appear to have summarily deported migrants, asylum-seekers and refugees from the Spanish enclaves of Ceuta and Melilla, both of which share a land border with Morocco. The organization is not aware of any investigation into these incidents.

A standing agreement between Spain and Morocco to return migrants who cross into Spanish territory appears to be facilitating some of the deportations, in breach of international human rights standards.

France - Une jeune Kosovare arrêtée et expulsée lors d'une sortie scolaire

La Police aux frontières aurait ordonné aux professeurs de faire arrêter le bus qui conduisait les élèves afin d'emmener Léonarda, 15 ans. Le PS demande des comptes au gouvernement, Manuel Valls assure veiller «scrupuleusement au respect des droits des étrangers».

Léonarda, 15 ans, était dans le bus avec ses camarades, en route pour une sortie scolaire, quand la Police aux frontières est venue l'arrêter pour l'expulser. Sur son blog hébergé parMediapart , le Réseau Éducation Sans Frontières (RESF) relaie le récit d'enseignants du collège André-Malraux et du lycée Toussaint-Louverture de Pontarlier, dans le Doubs, département où vivaient le couple Dibrani et ses six enfants. Déboutés de leur demande de droit d'asile, ces huit membres de la communauté rom ayant fui le Kosovo résidaient dans un centre d'accueil de demandeurs d'asile à Levier, et vivaient en France depuis cinq ans. Selon le blog, les enfants parlaient parfaitement français et étaient scolarisés depuis plus de trois ans. «Dans deux mois, ils entraient de plein droit dans le cadre de la circulaire Valls et pouvaient être régularisés», indique l'article, évoquant la circulaire du 28 novembre 2012 sur l'admission au séjour.

Rescatan a diez inmigrantes en una balsa neumática de juguete en el Estrecho

Salvamento Marítimo ha rescatado hoy a diez inmigrantes de origen subsahariano cuando intentaban alcanzar las costas españolas a bordo de una balsa neumática de juguete en aguas del Estrecho de Gibraltar.

Según han informado fuentes de Salvamento Marítimo, la actuación se ha producido como consecuencia de una llamada de teléfono recibida por el Centro de Coordinación de Salvamento (CCS) Marítimo de Tarifa (Cádiz) alertando de la presencia de una embarcación en la zona.

Inmediatamente, se ha activado un dispositivo de búsqueda, siendo finalmente la embarcación Salvamar Alkaid de Salvamento Marítimo la que ha localizado la balsa a 2,5 millas al sur de Tarifa.

A bordo de la misma viajaban un total de diez inmigrantes de origen subsahariano, todos ellos varones y mayores de edad, que han sido trasladados al puerto de la localidad gaditana en aparente buen estado de salud.

SOS Europe - La mer est un cimetière pour les migrants - 13 000 personnes sont décédées au cours de ces 25 dernières années

A l’occasion de la rencontre avec le Président du Parlement européen, Nicolas Beger, Directeur du Bureau des institutions européennes d’Amnesty International, revient sur les raisons de la mobilisation de plusieurs sections d’Amnesty International en Europe.

Lors du naufrage du navire de croisière Costa Concordia au large des côtes toscanes en janvier 2012, 32 personnes ont perdu la vie. Ces morts tragiques ont été amplement couvertes dans les médias, qui sont à nouveau revenus sur les conséquences de la catastrophe un an après. Il ne fait aucun doute que 32 décès qui auraient pu être évités méritent que l’on s’en rappelle.

En revanche, le 6 avril marquait les deux ans d’un naufrage catastrophique au large de l’île italienne de Lampedusa. En plein conflit libyen, un grand navire a quitté le pays, avec à son bord des passagers espérant trouver la sécurité en Europe. Nous ne saurons jamais précisément combien de personnes se trouvaient à bord, mais on estime qu’il y avait 200 à 300 passagers. Des familles entières provenant de pays comme la Somalie ou le Soudan avaient entrepris ce voyage périlleux vers l’Europe, car elles n’avaient plus aucune autre possibilité. Seules 51 personnes ont survécu.


Peut-être en avez-vous été informé dans le journal du lendemain? Ou peut-être la commémoration de ce drame est-elle apparue dans votre fil d’infos tweeter ? En fait, vous n’en avez probablement rien su, car il n’y a eu aucune commémoration, et quand bien même vous feriez une recherche sur Google, vous n’apprendriez guère plus de détails.

Des milliers d’enfants, de femmes et d’hommes ont péri en mer Méditerranée au cours de ces 25 dernières années. D’après les informations parues dans la presse qu’a pu recenser l’organisme de surveillance Fortress Europe, plus de 13 000 personnes sont décédées en Méditerranée et dans l’Atlantique, au cours de leur traversée vers l’Europe. Nombre de ces décès auraient pu être évités.

Giusi Nicolini, le maire de Lampedusa, s’exprime ainsi :
Quelle taille le cimetière de mon île doit-il atteindre? Je ne peux pas comprendre comment une telle tragédie peut être considérée normale. Je suis indigné par la banalisation qui semble s’être propagée comme une maladie contagieuse.

Les pays de l’Union européenne s’enorgueillissent de notre adhésion aux valeurs des droits humains. Mais si nous nous permettons de détourner simplement le regard lorsque des personnes meurent au large de nos côtes, nos déclarations ont-elles le moindre sens ?

Ces dix dernières années, les gouvernements européens ont fait le choix de plus en plus affirmé d’exclure les migrants en appliquant des mesures qui les forcent à choisir des itinéraires dangereux pour atteindre l’Europe. Les conséquences de ces voyages sont souvent fatales. Les pays européens ont renforcé les contrôles aux frontières, en menant des opérations d’interception, de renvoi et de dissuasion dans l’espoir d’empêcher les personnes d’entrer sur notre territoire. Ces mesures de contrôle des migrations ne sont pas toujours conformes aux obligations des pays en matière de droits humains. Les migrants, les réfugiés et les demandeurs d’asile continuent à subir de graves violations des droits humains en conséquence directe de la politique de l’Union et de sa pratique d’externalisation des contrôles aux frontières et du contrôle des migrations aux pays voisins.

Il est temps de renverser la tendance. Notre action « SOS Europe », menée devant le Parlement européen mercredi, a pour vocation de couvrir l’Europe de honte. L’Europe des décideurs comme celle des citoyens. Combien de temps encore laisserons-nous faire en silence ?

Le 24 avril, un « bateau migrant » arrivera place du Luxembourg pour remettre plus de 50 000 signatures de personnes ordinaires. Toutes exhortent les députés européens à honorer leur devoir en garantissant un examen public des accords et des opérations relatifs au contrôle des migrations. Notre bateau représente tous les migrants, réfugiés et militants de l’Europe entière qui demandent que les gouvernements nationaux rendent visibles toutes leurs actions aux frontières de l’Europe et qu’ils puissent être tenus de rendre des comptes en cas de violation.Notre bateau rendra hommage aux milliers de personnes mortes en mer. Parce que nous nous sentons concernés. Nous devrions tous nous sentir concernés. Nous devrions tous avoir honte, aussi. Et nous devrions tous être indignés.
